Welcome to Avanor Growth. These Terms of Service (“Terms”) govern your use of our website and any marketing, creative, advertising, consulting, development, or related services provided by Avanor Growth.
By accessing our website, requesting a proposal, purchasing a service, approving a project, or entering into an agreement with Avanor Growth, you acknowledge that you have read and agree to these Terms.

Depending on the selected service, our work may include:

The exact scope, deliverables, timelines, and fees for each engagement will be defined in the applicable proposal, quotation, service agreement, invoice, or other written communication approved by both parties.
2. Service Agreements & Scope of Work
Before work begins, Avanor Growth may provide the client with a proposal, quotation, package description, statement of work, or service agreement outlining the agreed services.
Only services and deliverables specifically included within the agreed scope are included in the project or monthly package.
Any additional work requested outside the agreed scope may:

Require additional fees;

Require additional delivery time; or
-
Be treated as a separate project.
Avanor Growth will communicate any material additional charges before proceeding with out-of-scope work.
3. Client Responsibilities
To provide services effectively, clients are responsible for supplying the information, materials, approvals, credentials, and access reasonably required to complete the work.
This may include access to websites, hosting accounts, advertising accounts, analytics platforms, social media accounts, business information, brand assets, photographs, videos, product information, and other relevant materials.
The client confirms that they have the necessary rights and permissions to provide any materials supplied to Avanor Growth.
Delays in providing information, access, feedback, or approvals may result in corresponding delays to project timelines.
4. Fees & Payment
Fees will be communicated before services begin through a proposal, invoice, quotation, package, or service agreement.
Unless otherwise agreed in writing:

Payments must be made according to the payment schedule stated in the applicable proposal or invoice.

Recurring services are billed according to the agreed billing cycle.

Avanor Growth may require an upfront payment or deposit before beginning work.

Work may be paused when an invoice becomes overdue.

Additional services outside the agreed scope may be invoiced separately.
All applicable transaction charges, payment processing fees, taxes, duties, or similar charges may be the client’s responsibility where required.
5. Advertising Budgets
Fees paid to Avanor Growth for advertising management do not include advertising spend paid to platforms such as Meta, Google, or other advertising networks unless specifically stated otherwise.
Clients are responsible for funding their advertising accounts and paying advertising platforms directly unless another arrangement has been agreed in writing.
Advertising budgets and Avanor Growth’s management fees are separate expenses.
6. No Guarantee of Marketing Results
Avanor Growth uses professional strategies, industry knowledge, research, testing, optimization, and data to pursue the best possible results for our clients.
However, digital marketing performance is influenced by numerous factors outside our control, including market conditions, competition, consumer behaviour, platform algorithms, advertising costs, website performance, pricing, product demand, and changes made by third-party platforms.
Therefore, Avanor Growth does not guarantee specific:

Revenue or sales;

Number of leads;
-
Return on advertising spend (ROAS);
-
Return on investment (ROI);
-
Search engine rankings;
-
Website traffic;
-
Social media followers;
-
Engagement rates; or
-
Advertising performance.
Any forecasts, projections, estimates, case studies, or examples are provided for informational purposes and should not be interpreted as guarantees of future performance.
7. SEO Services
Search engine optimization is an ongoing process and rankings may fluctuate.
Avanor Growth cannot control or guarantee how search engines such as Google rank websites or when search engines will crawl, index, update, or display particular pages.
Search engines may change their algorithms, policies, ranking systems, or features at any time.
Avanor Growth will use reasonable professional practices to improve organic visibility but does not guarantee a specific ranking position or timeframe.
8. Social Media & Third-Party Platforms
Our services may involve third-party platforms including Meta, Instagram, Facebook, Google, WordPress, hosting providers, email marketing platforms, analytics providers, and other software.
Avanor Growth does not own or control these third-party platforms.
We are therefore not responsible for outages, algorithm changes, policy changes, account restrictions, suspensions, advertising disapprovals, platform errors, security incidents, or other actions taken by third-party providers.
We will provide reasonable assistance where appropriate, but final decisions regarding third-party accounts remain with the applicable platform.
9. Website Design & Development
For website projects, clients are responsible for reviewing and approving the website before final launch.
Unless specifically included within the agreed package, ongoing website maintenance, hosting, premium plugins, third-party software, domain renewals, security monitoring, and future website modifications are not automatically included.
Avanor Growth is not responsible for problems caused after delivery by unauthorized modifications, outdated third-party software, hosting providers, malware, third-party plugins, or changes made by the client or another service provider.
10. Content, Photography & Video Production
Where Avanor Growth provides content creation, photography, video production, reels, graphics, or similar creative services, the exact number and type of deliverables will be determined by the selected package or project agreement.
Clients are responsible for obtaining any permissions required for locations, individuals, products, trademarks, or other materials appearing in content unless Avanor Growth has specifically agreed to handle those permissions.
11. Revisions
The number of revisions included in a project or service may be specified in the applicable proposal, package, or agreement.
Requests that substantially change an approved concept, strategy, design direction, website structure, campaign, or previously completed work may be considered additional work and may incur additional charges.
12. Approvals
Avanor Growth may request client approval before publishing advertisements, websites, social media content, designs, videos, campaigns, or other materials.
Once the client approves a deliverable, Avanor Growth may rely upon that approval to proceed.
Clients are responsible for reviewing materials for factual accuracy, pricing, offers, legal claims, product information, spelling of names, and other business-specific information before final publication.
13. Intellectual Property
Unless otherwise agreed in writing, Avanor Growth retains ownership of its internal processes, strategies, frameworks, templates, methodologies, systems, reusable assets, know-how, and pre-existing intellectual property.
Upon full payment, clients will generally receive the agreed usage or ownership rights to final custom deliverables created specifically for them, subject to any third-party licensing restrictions.
Third-party assets including fonts, stock photographs, software, plugins, templates, music, or other licensed materials remain subject to their respective licenses.
14. Portfolio Rights
Unless confidentiality requirements or a separate written agreement state otherwise, Avanor Growth may display completed public-facing work for portfolio, case-study, marketing, award, or promotional purposes.
Confidential client information will not intentionally be disclosed as part of such use.
Clients may request that confidential or unreleased work not be publicly displayed.
15. Confidentiality
Both parties agree to use reasonable care to protect confidential business information received during the engagement.
Avanor Growth will not intentionally disclose confidential client information to unrelated third parties except where necessary to provide the services, where authorized by the client, or where disclosure is required by law.
16. Cancellations & Termination
Cancellation and termination conditions may vary depending on the selected package, project, or service agreement.
Clients remain responsible for fees associated with work already completed, committed resources, approved expenses, and any non-refundable third-party costs incurred before cancellation.
For recurring services, any required notice period will be specified in the applicable agreement.
Avanor Growth may suspend or terminate services where payments remain overdue, the client materially breaches an agreement, unlawful activity is involved, or continued service would create unreasonable legal, security, or reputational risk.
17. Refunds
Because Avanor Growth provides professional services involving time, strategy, creative work, and resource allocation, payments for work already performed are generally non-refundable.
Any refund eligibility will depend on the applicable service agreement, project status, work completed, and expenses already incurred.
Third-party costs and advertising spend are generally non-refundable by Avanor Growth.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Avanor Growth will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the use of our services or website.
Where liability cannot legally be excluded, Avanor Growth’s liability will be limited to the extent permitted by applicable law.
Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
19. Website Use
Visitors may use the Avanor Growth website for legitimate informational and business purposes.
Users must not intentionally attempt to:
